Sigma Chi Sues Mason Administrators
Says Mason Violated its 1st and 14th Amendment Rights

George Mason University’s chapter of the Sigma Chi Fraternity sued the university for violating their First and Fourteenth Amendment rights, as stated by court records filed in an Alexandria district court on Aug. 31, 2007. According to Sigma Chi’s court documents, the complaint was “seeking declaratory and injunctive relief and money damages” following the university’s 10 year suspension of the fraternity.
The university’s suspension of the fraternity was triggered from a series of events that occurred between Sigma Chi and Mason administrators since the spring of 2005. According to Mason court records, on two different dates, two female Mason students alleged that they were sexually assaulted at a Sigma Chi sponsored party and the two females, who were underage, were provided alcohol by Sigma Chi fraternity brothers. When the first complaint was filed by the female in the spring of 2005, the fraternity brother was “found guilty of sexual assault” during the Sept. 13, 2005 hearing, according to Mason court records.
As stated in the Mason court documents, the second incident resulted in the university scheduling a hearing for the charges against the fraternity brother on Dec. 15, 2005. According to the court documents, both the defendant and the plaintiff “presented evidence and at the conclusion of the hearing, the panel found [the fraternity brother] guilty of sexual assault.” Prior to the second sexual assault hearing, Sigma Chi was confronted by Student Activities. According to Sigma Chi court records, on Dec. 7, 2005:
| “Several Sigma Chi members and pledges broke out into an innocuous Sigma Chi song, while walking together on campus. Defendant Michelle Guobadia, who serves as the Associate Director for Student Activities, Greek Life, saw this activity through her office window and immediately concluded that Sigma Chi was hazing its pledges.” |
The fraternity court records state that later that same day, Assistant Dean Blank-Godlove expressed her concern to Goubadia that “one of her students might have been hazed by Sigma Chi,” because during a class earlier that day he asked the student, a pledge of the fraternity, why he could not retrieve an assignment from his home, only to have the class’s peer advisor tell her that it was a “fraternity thing.”
According to Mason court records, “both these incidents were considered to be violations of the University’s hazing policy.” In a copy of the letter included in Sigma Chi’s court documents, Goubadia writes that there are “allegations that the fraternity has been conducting an illegal membership education process that has resulted in hazing, hosted and/or sponsored ‘parties’ and/or social gathering that have violated Sigma Chi’s national risk management polices.” On Feb. 23, 2006, representatives from the fraternity met with Associate Dean of Students Pamela Patterson to “receive official charges of violations of the Judicial Code.” Following the meeting, the university gave the Sigma Chi’s representative a written list of the charges. According to Mason court documents, the list of charges are described as follows:
1) Hazing - 8:30 a.m. on Dec. 7, 2005, in the area of Fenwick Library on the George Mason Campus
2) Providing alcohol to minors – Sept. 7, 2005
3) Underage consumption of alcohol – Sept.7, 2005
4) Sponsoring a party under conditions that resulted in sexual assaults on a female guest - Feb. 26, 2005 and Sept. 7, 2005
Sigma Chi documents state that after receiving the letter, which “significantly altered the nature of the disciplinary process, Sigma Chi sent a letter to Defendant Merten advising him of the unconstitutional actions of the GMU administration.” The documents then go on to read that “to Sigma Chi’s knowledge, Defendant Merten took no action to advise, train or otherwise supervise, the GMU administration or potential members of the Hearing Panel at any point in time.”
In an email written by Patterson to Sigma Chi president Scott Bush, a hearing was scheduled for May 4, 2006. During the five hour hearing, the “university presented evidence of underage drinking at two separate Sigma Chi sponsored parties, two sexual assaults based on the university’s earlier finding that occurred during a Sigma party and by Sigma Chi brothers, and finally, the university presented evidence of two separate incidents of hazing rituals by Sigma Chi.” According to Mason court documents, the Judicial Board “rendered a decision and found Sigma Chi guilty of three of the four charges.” The board then recommended that “Sigma Chi’s recognition as a GMU fraternity be revoked and Sigma Chi should not be allowed to apply for reinstatement until Sept.1, 2016.” Dean Patterson “accepted the Judicial Boards’ finding and recommended sanctions.”
Sigma Chi court documents state that the fraternity “appealed the decision to [vice president of University Life Sandy Hubler], who denied the appeal outright without addressing any of the issues raised therein.” In the letter dated June 2, 2006, Hubler writes, “you failed to provide new evidence, identify a defect in the proceedings or specify a standard of fairness that was abridges. Consequently your appeal is denied.” On June 2, 2006, the university maintained its decision to “accept the Judicial Board’s finding and recommended sanction,” according to Mason court records.
Currently, Sigma Chi is unrecognized as an organization by Mason and is “prohibited from participating in recruiting activities for the duration of the ten year suspension,” read the fraternity’s court records. The fraternity filed a motion for a Preliminary Injunction that the 10 year suspension be lifted, so that the organization can recruit new members and “avoid further harm as a result of the unconstitutional suspension imposed by GMU.”

This is one of the worst stories and not surprisingly your facts are wrong.
You guys at the broadside have dragged fraternities names through the dirt
for as long as I've been at this university.
You should prepare yourselves for a lawsuit because not only is this
information innacurate and one-sided, it's defamatory. Bravo, Broadside,

I happen to know for a fact that one of the brothers who you claim was
found "guilty of sexual assault" went on to earn his Bachelors from
Mason...interesting. I hope he sues the broadside as well!

Freedom of speech, its in the constitution. Now if you don't want to hear
all these fibs, lies, and or stories, blame the liberals for changing are
laws to fluctuate on that. don't blame the school blame the liberals!

An unfortunate situation. However, this goes on to say that one or two
idiot brothers, or members of an organization can literally screw a whole
group's image, as well as their overall reputation as a whole. Broadside
writers, just like any other liberal news organization, will report the
news as they see fit. The only thing greek organizations can do is repair,
regroup, and continue working to prevent idiot members into their
organizations and continue doing what we are best at, which is accumulate
higher average GPA's than the average student, continue doing more
community service, fundraising, and awareness events than any other
organizations on campus, and continue being proud of belonging to their
respective organizatons by representing proudly, with dignity, and with a
clean slate. Any small snafu will quickly, as you see above, explode into
scandal. Mason administrators seem bent on prosecuting us on the slightest
errors, so remember our learned Greek ethos, our creed, and continue
cleaning our image so tarnished by those who wish to oust us.

Ray: I've seen the fraternity GPAs and they definitely aren't higher than
the average student.
However, I see Mason as trying to get rid of Greek Life. Excuse me, I mean
"Fraternity and Sorority Life".
We call it the fun police, and they're out to kill it!

Broadside is worthless. They like to aid the university in "stamping out"
all illegal drinking. It's not a question of whether or not we are having
fun anymore, it's there prerogative to kill a normal school atmosphere. Why
do you think Princeton Review rated GMU 14th most unhappy school in the
nation? There is a reason schools like Tech, JMU and even UVA have more
school spirit and better on-campus lives. That is largely to do with
Fraternities and Sororities, because they are outlets for stress relief,
and help you contribute to society. Broadside, you should be dismantled,
and Expulsion should come back as the front runner in news!

Obviously, some of the commentators were involved in all the alleged
shenanigans. Why don't these guys step up and set out the facts? Why are
they hiding and making wild, baseless accusations about OTHERS? Why hasn't
Merten gotten more involved in these constitutional and party issues?

The bottom line is this...if the women were drinking underage...no one
"forced" them to drink...they should be locked up for drinking illegally.
They knew what they were doing and probably got busted and made up the
whole thing.
Fraternites and Sororities are just this...a bunch of immature kids who
party and live it up...go out in the real world and see your "brothers" and
"sisters" in the work force and see if they don't cut your throat in the
job market...obviosuly this is the case at this party...
As far as the school...let the aw handle the situation and make the people
who did it pay...don't make everyone suffer....this whole thing sounds like
a Sociology class at Mason...

I can't believe some of these previous comments going back to the "blame
the victim" thing? Doesn't anyone care about the girls who were sexually
assaulted? And yes, maybe they shouldn't have been drinking underage but I
think it would be few and far between of us that have been to college and
haven't done that.
Its sad when a few f-ups ruin something for an organization but I applaud
Mason for taking a stance against this kind of behavior in a University
endorsed social setting. If they want to do this, let them get their own
independent fraternity, but I personally wouldn't want sexual assault to
have any affiliation with my University whatsoever.

For those in Sigma Chi that are still sitting there thinking they are right
and that your due process rights have been violated you are WRONG!!!!First
off this is a public university so yea you have the right to form a group,
but when that group violates rules set forth by its governing body then
they have the right to kick you off...You will lose your lawsuit in the
federal court all the way to the Supreme court if thats what it takes.. but
in the end you will lose...no if's and or buts...don't think this is
someone who hates fraternity's b/c it's not. I was in one at mason and I
was on the IFC EC when some of this started going down...so you do not have
my sympathy.

I think this whole thing is a bit sketchy! So...the facts are that a couple
of girls claim they were sexually assaulted! Did they go to the hospital or
call the police? Sounds like somebody got dumped and planned revenge....I
bet she watches those Lifetime movies...hmmmm! I wonder if their were any
legal consequences for the girls who were drinking underage...I bet not!
And then some school officials saw pledges walking and singing together? I
should sue the school system for making me say the Pledge of Allegiance
every day as a kid.....isnt that the same thing? Hazing is defined as an
often ritualistic test and a task, which may constitute harassment, abuse
or humiliation with requirements to perform random, often meaningless
tasks, sometimes as a way of initiation into a social group. The definition
can refer to either physical (sometimes violent) or mental (possibly
degrading) practices; it may also include an 'erotic' element (notably
nudity). So...how is this hazing? Were the pledges naked singing a Nelly
song or something? Then there is that one last interesting fact.....the
brother convicted of Sexual Assault was allowed to continue his education
and graduate from George Mason University! If they are so hell bent on
providing a SAFE environment for its students then why would this "sexual
predator" be allowed to continue going to school at GMU! Oh, that's
right....he PAYS to be there. Why are there no individuals being held
accountable for their actions in all of this?

ok stop crying sigma chi/broadside activist.
My experience with Sigma Chi during the 2005-2006 semester consisted of
physical abuse in regards to hazing and sleep deprevation and on NUMBEROUS
instances witnessed first had that alcohol was supplied to HUNDREDS of
individual female underage students. The two females who "stepped up" in
confronting the crimes that were committed onto them (although they are not
blameless in voluntarily drinking to the point they allowed themselves to
be volnurable)should be taken seriously. To be honest with you at least a
half dozen co-eds would get drunk past the point of consciousness where a
Sigma Chi brother would have the ability to physically take advantage of
them at a party. Unfortunately the numbers of physical sexual assault as a
result of Sigma Chi parties are alot higher then just those two instances.
And lets not use the excuse that "two idiot" brothers are screwing this up
for everyone else, this was an atmosphere encouraged by ALL the brothers.
Its pathetic that these men are raised on the belief that they need to get
there peers wasted on alcohol in anticipation for getting their "sticks
wet". Why can't these men attract their fellow co-eds with non-alcohol
influenced eyes. And there treatment of pledges should be intolerable. No
wonder close to half end up quiting before big brother weekend.
